OSHA Walkaround Rule

On April 1, 2024, OSHA published a new inspection “walkaround” rule that purports to allow third-parties, including labor union organizers, to accompany its on-site inspections – even if there is no labor union currently representing workers. The final rule goes into effect on May 31, 2024, unless enjoined by a federal district court. Meanwhile, contractors should understand the new rule and what options they have for how to address on-site inspections when OSHA may try to bring a third-party, such as a labor organizer or community activist. Although OSHA refers to the new rule as a “clarification,” it is a dramatic departure from the plain language of the OSH Act and decades of precedent on access to job sites. Phillip Russell, OSHA attorney with Ogletree Deakins, will discuss the new rule and options for contractors to consider, including possibly denying access to anyone other than OSHA personnel. This is a limited capacity webinar for IEC members only.

Complying with New Leave Legislation: Best Practices for Oregon Employers

Oregon employers are responsible for ensuring that their leave tracking systems properly account for an employee’s leave taken under each (or any combination) of potentially applicable laws, including Paid Leave Oregon, the Oregon Family Leave Act (OFLA), or the federal Family and Medical Leave Act (FMLA). However, each of these three laws differ in multiple respects, which often complicates the coordination of leave. Adding to the complexity, effective July 1, recent legislation will impact current practices relating to concurrency, qualifying reasons for leave, and potential protected leave entitlements. To assist employers in navigating these upcoming changes, Stacie Damazo will lead employers in a discussion of leave administration best practices.
